Dangerous driving causing death is a serious traffic offence. The penalties for dangerous driving can be severe, particularly in the case where death or grievous bodily harm is caused to another person. It is critical in cases such as these that you appoint a specialised traffic lawyer, such as GC Traffic Lawyers, to defend you in Court and to avoid or minimise jail time, licence suspension and fines.

To be found guilty of dangerous driving, it may not be the case that you were actively driving recklessly or hooning, it may be that you only had a momentary lapse in concentration. In the last year, GC Traffic Lawyers represented a client in a particularly sad case which involved the death or a road user. Our client was a working man, who had a clean licence and hadn’t ever been convicted of any traffic offence in over 3 decades of driving. He had a job and a family and was a reputable, well respected member of the community. Then one day, when he was turning right across traffic, he lost concentration and didn’t notice a motorcycle rider and hit him. Sadly, the accident resulted in the death of the motorcyclist. As a result of this accident, our client was charged with Dangerous Operation of a Motor Vehicle causing Death, which has a maximum penalty of 10 years in prison. As he was driving dangerously in the moment of the accident, he pleaded guilty to the offence.

If this particular client had been adversely affected by alcohol or drugs or had been travelling at high speed or had left the scene of the accident, then the maximum penalty would have been far worse with a maximum penalty of 14 years. In this case however, none of these applied, it was just a momentary mistake which had terrible consequences. The client didn’t actually go to prison for this offence, instead, with our representation, received a 5 year fully suspended sentence. The Magistrate recognised that he was full of remorse and to apply an immediate jail term wouldn’t be appropriate.
